The U.S. Justice Department sued Sheriff Joe Arpaio on Thursday, saying the Arizona lawman refused for more than a year to turn over records in an investigation into allegations his department discriminates against Hispanics.

The lawsuit calls Arpaio and his office's defiance "unprecedented," and said the federal government has been trying since March 2009 to get officials to comply with its probe of alleged discrimination, unconstitutional searches and seizures, and jail policies that discriminate against people with limited English skills

Arpaio had been given until Aug. 17 to hand over documents the federal government first asked for 15 months ago.

* Violent crime rates are up in Arpaio’s jurisdiction while they have fallen throughout the rest of Arizona.

* Arpaio has failed to serve over 40,000 felony warrants. Arpaio is suspected of misspending $50 million in taxpayer funds and has refused to turn over records for an investigation.

* Over 2,700 lawsuits have been filed against Arpaio and he’s been investigated by the FBI and the U.S. Departments of Justice and Labor.

* Evidence exists that Arpaio forced an undocumented mother to give birth while handcuffed to a bed. * Violent crime rates are up in Arpaio’s jurisdiction while they have fallen throughout the rest of Arizona.

And all of this for what? For a jihad against immigrants that is based on lies and fear mongering? When the governor of Arizona claims there are beheadings in the Arizona desert despite all evidence to the contrary, when McCain claims his state is a lawless haven for villainy and scum, and when busboys, maids, and landscapers are blamed for drug-related violence on the borders, you know immigrant bashers have lost their minds.

McSpocky, having watched several interviews with Arpaio, it is Loozerio's opinion that Arpaio is, sadly, just another arrogant dime-a-dozen tin pot dictator with a special penchant for putting the jackboot to Hispanics.

If Arpaio has nothing to hide, he should turn over the documents and records requested by the DOJ. He should also realize that furthering what can be easily construed as obstruction of justice may lead to his office being duly and lawfully seized and restructured as deemed necessary by the feds.

Eh, when convicted and sent off to prison, hopefully he ends up sharing a cell with a member of the Mexican mafia, or any other Mexican gang member that's locked up. They'll make sure he has an enjoyable stay while behind bars.

you know, a guy does his job well enough that the crime rate has gone down for something like 4 years in a row now, and you want to hang him for it.

isabella, that is a terrible thing to say. after all, the sherriff has been doing his best to see to it that your "mexican gang mamber" is not on the streets to make your life or the life of your family more enjoyable. its the honest law abiding residents of arizona that this man works for. if they vote him in, then they must appreciate the job he is doing.

Ha! It's really hard to know what will be taken seriously. To answer your question- NO. And I didn't mean actually imply our gov't was communist. I was only speaking of the absurdity of some of the hype. ;)

I wasn't at all familiar with this guy until last night when I started doing some reading. One method of lowering crime rates is solving crimes and getting criminals off the streets. Another method might actually be more effective:

http://en.wikipedia.org/wiki/Maricopa_County_Sheriff's_Office_controversies

under Arpaio, the MCSO may be improperly clearing as many as 75% of cases without arrest or proper investigation

The crime rate in Arizona has been declining for the past 10 years... The crime rate in Maricopa County has not gone down under Arpaio.

Here is what he is REALLY doing!

his jail system is subject to the most lawsuits and has the highest prisoner death rates in the US.

And you can guarantee that these guys (the sheriff and his "inner circle") are all squeaky clean? That there are no favors, protection for some criminals and not others, no drug dealer shakedowns, no deals with the bad guys trafficking in women, no deliberate framing of individuals who refuse to play ball, no side deals with the local black market, no planting evidence, no crime scene surgery, no deliberately false statements to the press?

Wow! Maybe the pope should make this guy a saint. Saint Arpaio of Maricopa County. . .

Wow, How was it made possible for this person to stall handing over evidence for more than a year? Unless he has something to hide or knows the evidence is incriminating, I would willingly hand it over rather than not...and chance going to jail.

Yes, I get that. The investigation has/had to have gone on well before he was ordered to surrender the records. In my weird world, if the Sheriff was being investigated by the Federal Government and ordered to turn over the records he would be put on administrative leave until the situation was resolved. I guess it's different in his little fiefdom. :)

Statistical analysis of state-level data shows that immigrants expand the economy’s productive capacity by stimulating investment and promoting specialization. This produces efficiency gains and boosts income per worker. At the same time, evidence is scant that immigrants diminish the employment opportunities of U.S.-born workers [...]

Over the long run, a net inflow of immigrants equal to 1% of employment increases income per worker by 0.6% to 0.9%. This implies that total immigration to the United States from 1990 to 2007 was associated with a 6.6% to 9.9% increase in real income per worker. That equals an increase of about $5,100 in the yearly income of the average U.S. worker in constant 2005 dollars. Such a gain equals 20% to 25% of the total real increase in average yearly income per worker registered in the United States between 1990 and 2007.

When the US Dept of Justice tells you to turn over records pertaining to a criminal investigation, failing to do so isn't "applying the law." It's defying the law.

Buckeye:

Yeah, ur right, yet, when DC starts enforcing the laws that they r suppose to, instead of going after a sheriff for doing *their* job, they can ask for the records. Until then, they need to clean up their own mess. It's always easier to point out the speck of dust in someone else's vision, but not being able to see the plank in one's own eye. DC should enforce the laws that Congress passes. They have failed.

Going after a sheriff is passin' the buck.

There is NO excuse for ignoring the law irrespective of the position you hold. For an officer of the law it is unconscionable to do that. To do so is contrary to the very oath law enforcement officers swear to honor. We do not get to chose which laws we abide by nor do we get to opt out if we just disagree with the politics behind those laws. Joe Arpaio is not beyond the law.

In my own small town there was an official who did not meet the legal requirements to run for office. They actually blamed illegal immigration for their own short comings!! I will be so happy when we stop behaving like we are living like "call of the wild"- devouring the people in weaker positions when we are in difficult times. During WWI, if a person was heard speaking German on the streets of many US cities, they were beaten up or otherwise punished. Think about the horrible treatment of the Japanese Americans during WWII. This is not any different. We have just changed the focus of our abuses of human rights. It is still racial targeting and it is reprehensible.

Couldn't agree more with nyghtshayde and the others with similar opinions. Sheriff Joe Arpaio is or should be an embarrassment to all of the wonderful law enforcement officers who do their jobs well and within the perimeters of the law everyday.

Small minds in charge are the most dangerous. What bothers me the most are the lies about beheadings and beatings and illegal traffic that are stretched as far from true as possible to get others to react. Sheriff Arpaio is one of those "Big Hat no Cattle" types that enjoys a position where he can wreak havoc and act like he's just "doing his job" and "protecting his people" from riffraff. This type of person gives all law enforcement people a bad name and keeps people suspicious of their motivations. Arpaio is a bully coward and manipulator for his own gain and nothing more.

ADad, Who do you think the Feds are? "Feds need to sue themselves". Sir the Feds are you and I. In order to sue the Federal Government you need to request permission to sue as you make the Federal Government and therefore are not able to sue yourself without permission. It usually is granted, but the point is when you want to sue remember it is you and me that you are wanting to sue.

Regarding Sheriff Arpaio, he is a very scary person. Today he has targeted the illegal immigrants, what or who will he target tomorrow? I have no problem with a officer doing his job as long as it is done in a fair and equal application of the laws. This man is a racist and nothing more. Back through our history groups have been identified and abused, denied equal protection simply based on their skin color, primary language etc. What will be his next group, Asians, Moslems, Irish, etc. Perhaps it will just be anyone who is different from him. Sheriff Arpaio's personality appears to be that which would be suited for joing the KKK here in Tennessee. Little men always need victims in order to feel big about themself.

He is applying the law...

...not very effectively. The crime rate in Maricopa County has gone up under his watch.

http://tucsoncitizen.com/three-sonorans/2010/07/17/the-notorious-record-of-sheriff-joe-arpaio/

Violent crime is down across the state of Arizona, but not in Maricopa County. The Arpaio approach is a proven failure at reducing crime. From 2002 to 2009, while the violent crime rate across the state as a whole decreased by 12 percent, the area policed by the Maricopa County Sheriff’s Office suffered a 58 percent increase in violent crime.

Conservative Think Tank Report: Arpaio’s Policies Are Ineffective, Harmful, and a Waste of Millions of Taxpayer Dollars[v]

In 2008, the Goldwater Institute, an independent, non-partisan public policy research organization with generally conservative views, issued a report cataloging the many failures of the Maricopa County Sheriff’s Office. The report’s overview explains, “Although MCSO is adept at self-promotion and is an unquestionably ’tough‘ law-enforcement agency, under its watch violent crime rates recently have soared, both in absolute terms and relative to other jurisdictions. It has diverted resources away from basic law-enforcement functions to highly publicized immigration sweeps, which are ineffective in policing illegal immigration and in reducing crime generally, and to extensive trips by MCSO officials to Honduras for purposes that are nebulous at best. Profligate spending on those diversions helped produce a financial crisis in late 2007 that forced MCSO to curtail or reduce important law-enforcement functions.”

There are enough like minds promoting the abominations of the Sheriff so word gets around that it is fine to be abusive and cruel to those the Sheriff considers "illegal" or "criminal". We should not be a society where others are tortured because we don't like who they are and think they are a threat just because someone else says they are a threat. This type of behavior causes a rift that incites violence so if Apiary incites this mindset others will heed his call and believe they are justified in attacks on the people Apiary disapproves of and is stalking. Those on the other end of the stick are suppose to take this abuse like they deserve it but sometimes they strike out and this is what Apraio is banking on just one slip to support his lunacy.

If any of the allegations against Arpaio were proven, would his staunch defenders continue to lick his jackboots?

You can count on it. :(

The more extremist and far right Good Old Boy Joe proves himself to be , the more his followers embrace him.

They will probably make canned soup out of His depends.

What kind of person handcuffs a woman's hands and feet when she's giving birth?

I can't say that I've had much of an opinion about this sheriff, but NO woman deserves that kind of treatment. Trust me on this, until that baby is born, she's not going anywhere!

There are doctors in the room; you can have guards at the door. Handcuffing a woman giving birth is just NOT acceptable. We don't do that to female murderers and other criminals, but it's OK because this woman was an illegal?

I can find NO sympathy for this man.

What better way to put egg on the face of the Obama Administration(which Is the objective of the right)than to turn over the necessary documents, if you have nothing to hide.

John Dillinger robbed banks, our beloved Sheriff robs credibility.

By the way Is he related to that other "famous" Sheriff.....Bull Connor?

He knows he's hiding something. Anyone on the extreme right with anything that would discredit the Obama administration would have revealed it by now.

He's playing the same mind game that Beck , Coulter , Limbaugh and O'Reilly play with their brainwashed minions. Sad that some Americans are so gullible , but race is always a hot issue to work with in America , and he plays his followers like a bad fiddle.

Arpaio ,is a reincarnation of Buford T. Pusser after senility has hit him. Arpaio doesn't enforce anything , he grandstands for publicity. There is no deterrent in making inmates wear pink garments and sleep out in the open , and in fact , several inmates have died while serving time in Maricopa County jail. Inmates are still human. Arpaio should be doing time in Arizona or Federal Prison for Civil rights abuses instead of walking around pretending he's enforcing the law.

Arpaio is doing the same thing that Beck is doing , playing on the basest of racist sentiment of the extremists who think that America should be all one color.

As far as the issue that the Feds should be enforcing the law , IF the Feds were to come in heavy handed and shut down and control the borders , then we would have a million whiny voices crying that the Feds are imposing on State's rights. The Borders belong to the states , as does the land , and a host of laws , including Posse Comitatus , keeps the Feds from being able to patrol the borders in large numbers.

    http://en.wikipedia.org/wiki/Posse_Comitatus_Act

Arpaio isn't trying to enforce the law , he's trying to keep his name in the headlines , and like Beck , he's using RACE as the volatile issue to do so , as RACE in America seems to be a very hot issue and stirs up more passions than any other issue lately.

Arpaio is a throwback to Bull Connor and the fire hose , German Shepherd bearing types of the 50's who were all to willing to abuse minorities for the sake of publicity. He is what we don't need in America , a grandstanding Cowboy , and a senile one at that. except for Sheriffs who are elected , other law enforcement MUST retire at 55 , when their instincts are gone. He's 20 years past that , and his only value is to hawk Depends undergarments while gumming his false teeth.

He is reckless , racist and dangerous , and he , like all old racists will soon be put out to pasture.

I came across a good site that details the abuses of Good Old Sheriff Joe , the rooting tootin Cowboy.

    http://www.arpaio.com/

It details all of the abuses of someone who has been elected to enforce the law. Seems he breaks more than he enforces.

The major problem with the Arizona situation is that first they all scream because the federal people "aren't doing their job", but when they do step in everyone starts screaming that they are "over-reaching their authority" and "meddling" in state business. Which way do they want it?

Let me see two separate grand jury investigations and $113 million federal money at stake for the county. Hmm!

    http://www.foxnews.com/politics/2010/09/02/justice-dept-sues-arizona-sheriff-civil-rights-probe/

    http://newamericamedia.org/2010/09/county-to-loose-fed-funding-thanks-to-sheriff-arpaio.php

At stake is $113 million in future funding from the federal government that goes toward county services from housing to childcare. While the sheriff's office receives about $3.8 million in federal funds, which is less than 5 percent of its budget, for the county the impact could be catastrophic.

"The health and welfare of our community shouldn't be at risk because one rogue agency doesn't want to provide records," said Cari Gerchik, a spokesperson for Maricopa County.

According to county records, the bulk of the funds, $50 million, goes to public health-care programs and another $20 million to housing programs.

Mary Rose Wilcox, a Maricopa County supervisor, said the lawsuit is a positive step in a long-awaited investigation over allegations of racial profiling of Latinos by sheriff's deputies. She said she was alarmed on the potential loss of funding that could affect county taxpayers.

Cannot imagine the there will be many happy people in the county as more become aware.

Gosh, over 2700 lawsuits, a whole boat load of ongoing accusations & claims of indisputable evidence of his horrific crimes against humanity & years of multiple investigations by civil rights & govt agencies have not resulted in even a minor criminal conviction against Sheriff Joe?

Guess the old sheriff must have the all-powerful devil protecting him or maybe everyone out to get him all these years has been supremely incompetent & stupid or, just maybe, some of the more monstrous accusations against him have been a tad exaggerated.

Whatever, I am sure the DOJ will use all the taxpayer money at their disposal & along with the ACLU will do whatever is necessary to convict him of a death penalty offense, or even worse, sentence him to wear pink undies & force him to pedal a bike to generate electricity to fuel his TV. Oh, dear, I don't even want to imagine the awful fate that the Feds & ACLU have in store for the sheriff.

I am kinda curious though why the Feds have not immediately taken all the illegal immigrants that the sheriff has arrested out of his jurisdiction & into their own facilities for their protection from such abuse.

Seems as if Arpiao has moved away from fighting crime and arresting dangerous felons to picking up illegals, this is not what he was solely elected to accomplish. Living in the state of Arizona I have not come across too many people who agree with Arpaios tactics. We need more people in this state to come out and cast thier votes. Further more he makes himself look so guilty by not turning over the documentation that the feds have requested. If you have nothing to hide then this should not be a big deal. I really am hoping that the Federal government hangs him and he finally pays for his crimes. He expects people to obey the law when he himself will not do so. What a joke!

Joe is and always has been a p*ssy, he is no tougher than a little girl, he belongs in his own concentration camp, and the fact that he is idolized by some, is revolting, and telling of what a @!$%# kicking, backward state Arizona is, whose entire state motto can be summed up by saying "we are trying to keep people from stealing the stuff we stole".
